Craig D. Gottilla


Craig Gottilla is a partner in the Community Association Department. He devotes his practice to representing condominiums, community associations, cooperatives and homeowners associations. Craig and his colleagues have more than 60 years of combined experience in the community association industry.

Craig counsels homeowners associations, condominiums and cooperatives on a wide range of legal matters, including:

  • Collections
  • Construction defect litigation
  • Delinquent assessments and common charges
  • Drafting and negotiation of service contracts
  • Fair housing compliance
  • Governance
  • Municipal services and relations
  • Restrictive covenant enforcement and interpretation
  • Rules and regulations
  • Transition negotiations with developers and/or sponsors
  • Fiduciary duties of board members

Craig has a deep background in real estate litigation, commercial litigation and insurance disputes, as well as extensive experience litigating in federal and state courts in New Jersey and New York.

Following law school, Craig served as the law clerk to the Honorable Clarkson F. Fisher Jr., presiding judge for the Chancery Division in the Superior Court of New Jersey, Monmouth County.

In 2019, he was appointed by the Camden County Board of Chosen Freeholders to a 5-year term on the Camden County Ethics Board, which focuses on ethics in government.

Representative Matters

  • Successfully appealed the denial of a claim by an insurance carrier for a condominium association for water and mold damage caused to multiple units
  • Secured successful no-cause verdict for a buyer on a breach of real estate contract action brought by a seller; secured a judgment requiring the seller to return the buyer’s deposit and pay all attorney’s fees and costs
  • Represented the SIPA trustee for the liquidation of Bernard L. Madoff Investment Securities, LLC, and the Chapter 7 Trustee of Bernard L. Madoff in connection with the recovery of assets for victims of Madoff’s Ponzi scheme
  • Obtained a summary judgment against an employee alleging sexual orientation discrimination and wrongful termination
